KID ZONE, LLC

PARENT WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK

Please complete this form before your child uses our playground facilities. This waiver helps ensure the safety of all children and acknowledges the inherent risks associated with playground activities.

Parent/Guardian Information

I have voluntarily elected to use, and if applicable, to allow the minor child(ren) identified above (“Child”), to use the facilities, equipment, party rooms, and services operated by Kid Zone, LLC at 340 West Antelope Drive, Suites A101, Clearfield, Utah 84015, and any other Kid Zone locations (collectively, the “Facility”).

In consideration for being permitted to enter and use the Facility, I represent, acknowledge, and agree as follows:

1. PARTIES RELEASED

This Agreement is intended to release and protect Kid Zone, LLC, and its owners, members, managers, officers, employees, agents, volunteers, affiliates, insurers, successors, and assigns (collectively, “Kid Zone”).

2. ASSUMPTION OF RISK

I understand and acknowledge that participation in activities at the Facility—including but not limited to climbing structures, slides, play equipment, party activities, and general play—is inherently risky.

These risks include, but are not limited to:

• Slips, falls, collisions, and entanglements

• Cuts, scrapes, bruises, sprains, fractures, head or spinal injuries

• Illness, allergic reactions, disease transmission

• Serious injury, paralysis, or death

I understand that these risks may result from my actions, the actions of the Child, the actions of other participants, or the condition of the Facility or equipment. I knowingly and voluntarily assume all risks, both known and unknown, for myself and the Child.

3. PARENTAL SUPERVISION

I understand and agree that Kid Zone does not provide child supervision.I am solely responsible for supervising, monitoring, and controlling the actions of all children under my care at all times while at the Facility.

4. RELEASE OF LIABILITY & WAIVER OF CLAIMS

On behalf of myself and the Child, I hereby release, waive, discharge, and covenant not to sue Kid Zone from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind, whether known or unknown, arising out of or related to:

• Use of the Facility or equipment

• Entry onto the premises

• Acts or omissions of Kid Zone or other participants

• Negligence (ordinary), failure to warn, or other conduct

This release includes claims for personal injury, illness, emotional distress, property damage, paralysis, or death.

5. INDEMNIFICATION

I agree to defend, indemnify, and hold harmless Kid Zone from any claims, damages, costs, or attorney’s fees arising out of:

• My actions or the actions of the Child

• Damage caused by the Child

• Any claim brought on behalf of the Child contrary to this Agreement

  
  

6. MEDICAL RESPONSIBILITY & EMERGENCY AUTHORIZATION

I understand that Kid Zone has no obligation to provide medical care.

I authorize Kid Zone and its employees or agents to obtain emergency medical treatment for myself and/or the Child if, in their reasonable judgment, such treatment is necessary.I agree that all medical expenses are my sole responsibility.

7. CODE OF PATRON RESPONSIBILITY

I agree that I and the Child will:

• Follow all posted and verbal rules and instructions

• Use equipment only as intended

• Avoid reckless behavior and physical contact with others

• Refrain from participation while under the influence of drugs or alcohol

• Not participate if suffering from medical conditions that increase risk

• Wear appropriate attire and remove hard or dangerous objects

• Observe all age, height, and capacity restrictions

• Go feet-first down slides

• Avoid overcrowding equipment

I agree to explain these rules to the Child and ensure compliance.

8. ARBITRATION & TIME LIMIT TO BRING CLAIMS

Any dispute arising out of this Agreement or use of the Facility shall be resolved by binding arbitration in the county where the Facility is located, Utah.

I understand that arbitration waives the right to a jury trial.Any claim must be brought within one (1) year of the date of the alleged incident (subject to applicable law for minors).

9. TERM & GOVERNING LAW

This Agreement is continuous and evergreen and applies to all future visits to any Kid Zone location.

This Agreement shall be governed by and interpreted under the laws of the State of Utah.If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

10. ACKNOWLEDGMENT & AUTHORITY

By signing below, I represent and warrant that:

• I am the parent or legal guardian of the Child

• I have authority to sign on behalf of the Child

• I have read and understood this Agreement

• I knowingly waive legal rights on behalf of myself and the Child
