1. Parking Fees and Charges
1.1 The first month's full or pro-rata parking fee, access card deposit (if any) and one-off account set up fee are required to be paid to KIWI PARKING on or before the commencement date.
1.2 The parking fee is payable to and must be received by KIWI PARKING monthly in advance on or before the 1st business day of each month.
1.3 KIWI PARKING may vary the parking fee at any time by giving the Parker a minimum of twenty eight days written notice of the alteration.
1.4 Any expense or costs incurred by KIWI PARKING in the recovery of outstanding monies, including debt collection fees and legal costs, shall be paid by the Parker.
1.5 A late payment fee of $25.00 GST inclusive per vehicle per month may be charged by KIWI PARKING on all outstanding monies.
1.6 Further terms and conditions of parking are displayed at the Car Park itself.
2. Access Control Device
2.1 The access card deposit will be retained by the Company unless the Application specifically states that the deposit is refundable.2.2 On the termination of this Agreement, a refundable access card deposit may be applied against any monies owing by the Parker to KIWI PARKING. Any surplus will be refunded to the Parker upon receipt by KIWI PARKING of the access card.2.3 Each access card and/or dash display card issued by the Company remains the property of KIWI PARKING and must be returned at the termination date of this agreement.2.4 The Parker will, if not in possession of a valid access card or dash pass when entering or leaving the car park, be liable to pay the maximum daily parking tariff then charged by KIWI PARKING or, at KIWI PARKING’s discretion, will be issued with a Payment Notice, requiring a payment as specified on the notice.2.5 The Parker must pay the standard amount charged by KIWI PARKING for the replacement of a lost or damaged access card.
3. Terms
3.1 If required, KIWI PARKING may relocate the parker with a minimum of 3 days’ notice in writing or by e-mail at any time.4.2 Unreserved parkers are on a permit-to-hunt basis with no guarantee of a space being available during peak times.
4. Termination
4.1 This Agreement may be terminated by either party giving a minimum of thirty days’ notice in writing or by e-mail to the other at any time.
4.2 KIWI PARKING may, at its discretion, accept one month’s Parking Fee in lieu of notice by the Parker.
4.3 KIWI PARKING may terminate this Agreement immediately if the Parker is in breach of this Agreement and does not immediately rectify that breach.
4.4 KIWI PARKING may terminate this agreement immediately if the Parker, in KIWI PARKING’s opinion, is found to be parking inconsiderately or the Parker’s behavior is objectionable.
4.5 Once this Agreement has been signed, termination can only occur as per clause 4.1, 4.3 and 4.4.
