LIABILITY
-The photographer's duties shall terminate if (1) in the photographer’s sole judgment the dog is dangerous or vicious to the photographer or any other person, animal or other dogs, or (2) the client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, the photographer’s duties shall terminate but all other provisions of this Agreement shall continue in full force and effect.
-The photographer takes the utmost care with respect to exposure, retouching, processing, delivery and archiving the digital photographs. However, in the unlikely event that photographs have been lost through camera malfunction, computer malfunction or destroyed for reasons beyond the photographer’s control, the photographer may offer a full refund or the opportunity to reshoot at no cost to the client.
-If the dog(s) cause property damage, or bites/injures any dog, animal or person (including but not limited to the photographer, client(s) or bystanders), during the photography session, then the client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify the trainer from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees.
-The client will be responsible and assumes the risk of all damages or injuries to their dog(s), themselves and participants in the session including any interaction between dogs participating, all destruction of personal, business or public property, or personal injury before proceeding, during and immediately following a session.
-Any breakage or damage to the photographer’s equipment due to the actions of the clients dog(s) is the sole financial responsibility of the client to replace equipment. Know your dog’s behavior and limitations before bringing them to any public area. Please disclose any behavioral or aggression issues before your session.
-Should the client’s dog(s) become frightened, agitated, or aggressive, the client understands that they must take immediate action to gain control over their dog and/or to remove their dog from the situation.
-The client further understands that the photographer reserves the right to physically remove the dog(s) from any situation where a disturbance is created where the dog(s) appear dominant or aggressive or that is deemed to be dangerous or undesirable.
-The client understands that their dog(s) must be leashed/under their control at all times. Any messes/accidents must be cleaned up immediately by the client; cleaning supplies will be provided by the photographer for in studio session. The client is responsible for all clean up requirements for public photo sessions.
-The client agrees they are solely responsible for their dog's actions during the photo session. The dog(s) should be well behaved/well mannered - if special requirements are needed for behavioral problems please be sure to discuss them with the photographer prior to your session.
-The client understands there will be no other dogs present during studio photography sessions.
-The client understands that when in public the photographer is not responsible for other humans/dogs being around during the session.
