Photography Client Contract

This agreement, between the client (owner) and the photographer (Rush Pack Photography) pertains to the above mentioned dog(s) for the previously discussed photography session.

SERVICE AGREEMENT

-I (Rush Pack Photography) will always do my best to fulfill your photography expectations. That being said there may be individual pictures, poses or scenes that do not turn out as hoped. If by chance none of the photos turn out as expected, the photographer will offer a free re-shoot of the photos.

-The photographer will provide the photography session previously discussed with the client (Studio(regular/mini) Sessions/Outdoor Sessions/Sport or Action Sessions/Celebration of Life Sessions/End of Life Sessions).

-The client agrees that they have reviewed, discussed, and understand pricing with the photographer prior to booking their session.

-The client agrees to cooperate to the best of their ability to allow the photographer to perform the session previously discussed. The client understands that the photographer is not held responsible for the action of others that may interfere with the photography session.

-If the client is more than 5 mins late for their session, the photographer is not responsible for adding additional time at the end of the session.

TRAVEL FEES

-The photographer agrees to drive up to 30 miles from Grain Valley, MO.

-Any additional mileage will be added to the clients final price at a rate of $0.67 a mile (for both directions of travel).

-Travel fees are waived for End of Life Photography sessions.

DIGITAL FILES

-The photographer will send a digital link to the client roughly 1-2 weeks after the client's session.

-The digital link will contain full resolution images from the client's session. From there the client can download/print/share pictures as they wish.

-Sporting events/trials may have a pay by photo agreement. The digital link will contain lower resolution photos with a watermark over the picture - from which individuals may reach out to order their full resolution photos. Once they pay for their pictures they will receive their own digital link with their full resolution photos.

-Digital links will remain active for up to 90 days from the day they are sent to the client.

ARCHIVE AND STORAGE

-The photos will remain active on their digital link for up to 90 days - they may be removed sooner depending on storage needs.

-After 90 days all proofed images will be backed up on an external hard-drive for up to a year, after a year they may be removed for more storage.

LIABILITY

-The photographer's duties shall terminate if (1) in the photographer’s sole judgment the dog is dangerous or vicious to the photographer or any other person, animal or other dogs, or (2) the client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, the photographer’s duties shall terminate but all other provisions of this Agreement shall continue in full force and effect.

-The photographer takes the utmost care with respect to exposure, retouching, processing, delivery and archiving the digital photographs. However, in the unlikely event that photographs have been lost through camera malfunction, computer malfunction or destroyed for reasons beyond the photographer’s control, the photographer may offer a full refund or the opportunity to reshoot at no cost to the client.

-If the dog(s) cause property damage, or bites/injures any dog, animal or person (including but not limited to the photographer, client(s) or bystanders), during the photography session, then the client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify the trainer from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees.

-The client will be responsible and assumes the risk of all damages or injuries to their dog(s), themselves and participants in the session including any interaction between dogs participating, all destruction of personal, business or public property, or personal injury before proceeding, during and immediately following a session.

-Any breakage or damage to the photographer’s equipment due to the actions of the clients dog(s) is the sole financial responsibility of the client to replace equipment. Know your dog’s behavior and limitations before bringing them to any public area. Please disclose any behavioral or aggression issues before your session.

-Should the client’s dog(s) become frightened, agitated, or aggressive, the client understands that they must take immediate action to gain control over their dog and/or to remove their dog from the situation.

-The client further understands that the photographer reserves the right to physically remove the dog(s) from any situation where a disturbance is created where the dog(s) appear dominant or aggressive or that is deemed to be dangerous or undesirable.

-The client understands that their dog(s) must be leashed/under their control at all times. Any messes/accidents must be cleaned up immediately by the client; cleaning supplies will be provided by the photographer for in studio session. The client is responsible for all clean up requirements for public photo sessions.

-The client agrees they are solely responsible for their dog's actions during the photo session. The dog(s) should be well behaved/well mannered - if special requirements are needed for behavioral problems please be sure to discuss them with the photographer prior to your session.

-The client understands there will be no other dogs present during studio photography sessions.

-The client understands that when in public the photographer is not responsible for other humans/dogs being around during the session.

RESCHEDULING & CANCELLATION POLICY

-Rescheduling Policy: If The photographer has to reschedule the session due to illness, weather, equipment malfunction, or other circumstances beyond the photographer’s control the photographer will make every effort to reschedule at the earliest possible date.

-The client may reschedule due to illness or weather but must reschedule at their earliest convenience. The client needs to reschedule within 1 month of their original photography date. It is the client sole responsibility to reschedule their session.

-If the client no call/no shows the photographer deserves the right to cancel any future photography sessions at their discretion.

-Cancellation Policy:

-If the client is more than 10 mins late without contacting the photographer, the photographer reserves the right to cancel the photography session. If the client would like to reschedule it is their sole duty to reach out to the photographer to do so; rescheduling the session is at the sole discretion of the photographer.

PHOTO RELEASE

-The photographer owns all copyrights and ownership of all images created and has the exclusive and unrestricted right to make reproductions to promote the business advertising, brochures, magazine articles, websites, exhibitions, competitions, sample albums and prints, and other such materials.

-I hereby assign and grant Rush Pack Photography the right and permission to use, reproduce, distribute, and publish photograph(s) after their photography session.

-I hereby authorize the reproduction, sale, distribution, copyright, exhibit, broadcast, and/or electronic storage of any and all such photograph(s), without limitation at the discretion of Rush Pack Photography and I specifically waive any right to compensation I may have for any of the foregoing.

The below signature serves as an agreement that this is a binding contract between the client (yourself) and the trainer (Rush Pack Photography) for the above selected training of your above listed dog.
