Health Waiver & Informed Consent

1.0 TERMS & DEFINITIONS:

For the purposes of this medical waiver, the terms "HEALING SESSION" or "HEALING SESSIONS" shall refer to any or all of the following ~

(1) Discussions and Consultations.

(2) Energy Healing i.e., Seikhem, Ashati, Alsemia, and Soul Rescue.

(3) Spiritual Healing and/or Trance Healing i.e., channeling the energies of Ascended Masters, Spirit Guides, Plant Spirits, Animal Spirits, the Spirits of minerals, Ancestral Healers and additional modalities of Healing.

(4) Sound Healing i.e., Solfeggio Tuning Forks, Percussion Instruments, Shamanic Drum, Tibetan Singing Bowls, Voice/Chanting and Affirmations.

(5) Vibrational Healing i.e., AuraSoma Vibrational Quintessence and AuraSoma Aura Sprays.

(6) Crystal Healing i.e., Crystals, Crystal Singing Bowls and Crystal Pendulums, and

(7) Plant Medicine ~ First Light Flower Essences of NZ.

This consent form is a requirement of my Energy Therapies Association Membership and Healthcare Professionals Civil Liability Insurance. It also coverts Public Liability Insurance for any venues used.

2.0 MEDICAL/HEALTH DISCLAIMERS:

I understand and acknowledge that any HEALING SESSION that I receive:

(1) are not intended to constitute or replace any advice given by a medical doctor and/or primary health care provider; or

(2) are not intended to be relied upon for prescriptions, recommendations, diagnosis, or treatment in relation to any health problems or diseases.

I understand and acknowledge that I am responsible for consulting my medical doctor and/or health care provider, in case I have, or suspect to be suffering from a health problem or disease.

I understand that if I am taking any medications or have any medical/health conditions such as, but not being limited to addictions, anxiety, depression, schizophrenia, bi-polar, epilepsy, heart conditions (including heart stents, loops or pacemakers etc), or pregnancy, that I must advise Nigel Eru before your session.

3.0 PERSONAL RESPONSIBILITY:

I also understand that even though I have been accepted as a client, I am responsible for any consequence resulting from any HEALING SESSIONS I've received from Nigel Eru.

4.0 PHYSICAL/THERAPEUTIC TOUCH:

I understand that HEALING SESSIONS may include 'hands-on' healing which may require physical or therapeutic touch designed to support me on my healing path, and by signing this waiver I am agreeing with informed consent to this. NOTE : Only applicable for "face to face" sessions and excludes all remote/distance healing sessions managed via phone or zoom.

5.0 WARRANTIES & GUARANTIES:

I understand and acknowledge that Nigel Eru makes no warranty, guarantee, or prediction that I will experience any state of awareness or consciousness during or after any HEALING SESSIONS, nor does Nigel Eru make any representation that I will experience any particular outcome connected to my health situation.

I understand and acknowledge that by participating in any HEALING SESSIONS, I do so at my own risk. It is with this understanding that I voluntarily sign this health waiver. Since all HEALING SESSIONS are experiential and the extent of the healing benefits are not fully known, I agree to assume and accept full, and complete responsibility for any known and unknown risks associated with my participation in the session including any physical injury, psychological or emotional effects, death, loss, or property damage.

6.0 IMPLANTS & ELECTRICAL DEVICES:

I understand it's my responsibility to advise if I have any of the following implants or electrical devices in my body ~ this includes: cardiac/heart pacemaker/pacing wires or implanted cardioverter defibrillator; artificial heart valve; electrical stimulator for nerves, brain or bone; implanted infusion or drug pump; coils, filters, shunts or stents; aneurysm clips; ocular (eye) implant; cochlear (ear) implants or hearing aids; dental implants; mechanically or electrically activated implants.

Implants & electrical devices can be impacted by energy healing modalities. If you have any of these present in your body we will need to utilise spiritual, trance, crystal and sound healing modalities.

7.0 RELEASES, INDEMNITIES & DISCLAIMERS:

In my personal name, and that of my heirs and assignees, I exonerate, totally and indefinitely, release and relinquish any suit, complaint, declaration, damage, cost and/or expense of any kind (that any such prosecution, complaint, declaration, damage, cost and/or expense is caused by the passive or active negligence of Nigel Eru) in connection with, or resulting from any discussion, consultation, and/or any HEALING SESSIONS I have receive from Nigel Eru.

8.0 ARRIVING EARLY OR LATE TO YOUR APPOINTMENT:

All sessions are scheduled for a fixed start and finish time. Clients are asked to arrive or log in no more than 5 minutes early to allow appropriate preparation and transition between sessions.

Arriving significantly early does not guarantee earlier access to the session space, nor does it extend your booked time. Please note that early arrivals may be required to wait until the scheduled start time.

If you arrive late, your session will still end at the originally scheduled time, and no additional time will be added. This ensures fairness to all clients and preserves the integrity of the practitioner’s schedule.

If you are running late, a minimum of 60 minutes’ notice is required. Clients who arrive more than 5 minutes late without sufficient notice may have their session shortened, rescheduled, or forfeited, at the practitioner’s discretion. Late arrivals or 'no shows' are not eligible for a refund.

9.0 YOU ARE COVERED FOR ANY ADDITIONAL HEALING SESSIONS WITHIN THIS CALENDAR YEAR:

This clause is for clients that have HEALING SESSIONS regularly and eliminates the need to complete additional consent forms. I understand that by signing this medical waiver, I will not be required so sign additional medical waivers for any other HEALING SESSIONS I attend during this calender year.

I also understand, that should ANY of my information change, including the status of any medical conditions, treatments and/or medications, then it is my responsibility to inform Nigel Eru immediately.

10.0 SIGNATURE:

By signing this health waiver, I agree to indemnify and hold harmless Nigel Eru from any claims, including the expense of litigation, associated with my participation — including any charges or expenses made by third parties.
